Pathway to PR for STSOL Subclass 482 visa holders:
As members are conscious, the Department within the March Skilled Newsletter 2022 included data on Subclass 482 and legislative modifications made by LIN 22/038 to implement an ENS TRT pathway for current TSS visa holders within the Short-Term stream, in accordance with the Minister’s 25 November announcement. included in that article was data that the pathway could be accessible for 2 years from its graduation on 1 July 2022.
Until the discharge of the Newsletter, this data had not appeared in writing. There is not any reference to the 2 12 months interval within the Instrument or the Explanatory Statement and the sundown date of the Instrument is 1 April 2023. As such, the 2 12 months interval seems to don’t have any legislative foundation or authority at the moment.
Given that in saying this concession on 25 November 2021, the Minister acknowledged …there are presently about 20,000 major Temporary Skill Shortage and 457 visa holders in Australia who might profit from these preparations …and the Department’s wording within the Newsletter that concessions are for current TSS holders, it may be presumed that the laws was initially meant to offer very restricted entry to this pathway.
As the laws in its present type doesn’t seem to align with the Minister’s or the Department’s intent, it could be anticipated that some rectification of the laws will happen.
